Services Agreement

1. Services Provided

1.1 Description of Services

Clean Peachy provides professional residential house cleaning services ("Services") at your property ("Property"). The specific services you select (Standard Clean, Deep Clean, and any add-on services) are detailed in your Service Contract, which is incorporated into this Agreement by reference.

1.2 Service Standards

We will perform Services in a professional and workmanlike manner, using standard cleaning products and equipment. We reserve the right to determine the methods, means, and personnel required to provide the Services.

1.3 Service Modifications

You may request changes to your service schedule or add-on services by contacting us at least 24 hours in advance. Changes may affect your pricing as detailed in Section 3.

2. Scheduling and Access

2.1 Service Schedule

Services will be provided on the schedule specified in your Service Contract (weekly, bi-weekly, or monthly). We will make reasonable efforts to accommodate your preferred day and time, but specific arrival times may vary.

2.2 Property Access

You agree to provide us with safe and unobstructed access to your Property during scheduled service times. This includes providing keys, access codes, or gate information as needed. You are responsible for securing pets and ensuring our team can work safely.

2.3 Cancellations and Rescheduling

• 24-Hour Notice Required: You must provide at least 24 hours' notice to cancel or reschedule a service.
• Late Cancellations: Cancellations with less than 24 hours' notice may result in a cancellation fee equal to 50% of the service price.
• No-Show: If we arrive for a scheduled service and cannot access the Property due to no fault of our own, you will be charged the full service price.

3. Pricing and Payment

3.1 Service Pricing

Your service price is specified in your Service Contract and is based on your property size, selected services, and frequency. Once your contract is created, your pricing is locked and will not increase due to changes in our standard rates.

3.2 Price Changes

While your contract pricing is locked, we reserve the right to adjust pricing in the following circumstances:

• You request changes to your service type or add-on services
• Your property size or layout changes significantly
• Extraordinary circumstances require additional time or resources
• With 30 days' written notice for general price adjustments (though your existing rate is protected)

3.3 Payment Terms

• Payment Method: You authorize us to charge your payment method on file.
• Billing Timing: We charge your payment method the day after completing each service.
• Failed Payments: If a payment fails, we will attempt to process it again. Services may be suspended until payment is received.
• Late Fees: Accounts unpaid for more than 15 days may incur a late fee of $25 or 5% of the balance, whichever is greater.

3.4 Automatic Renewal

Your service agreement continues indefinitely on your selected frequency until you cancel. You will be charged automatically for each scheduled service.

4. Customer Responsibilities

4.1 Property Preparation

You agree to:

• Pick up clutter, personal items, and valuables before our arrival
• Secure or confine pets during service
• Ensure all areas to be cleaned are accessible
• Provide adequate lighting and utilities (water, electricity)
• Disclose any hazards, special conditions, or health concerns

4.2 Communication

You agree to maintain accurate contact information and respond to our communications in a timely manner. We may send service reminders, confirmations, and notifications via SMS, email, or phone.

5. Satisfaction Guarantee

5.1 Our Commitment

We strive for your complete satisfaction. If you are not satisfied with any aspect of our service, please contact us within 24 hours of service completion, and we will return to re-clean the affected areas at no charge.

5.2 Limitations

Our satisfaction guarantee does not apply to:

• Issues not reported within 24 hours of service
• Areas that were inaccessible during service
• Damage caused by pre-existing conditions
• Items specifically excluded from our services

6. Liability and Insurance

6.1 Our Insurance

Clean Peachy maintains general liability insurance. We will make reasonable efforts to prevent damage to your property and belongings.

6.2 Damage Claims

If damage occurs during service:

• You must notify us within 24 hours of discovering the damage
• Provide photos and description of the damage
• Allow us to inspect and assess the damage
• Our liability is limited to the actual cost of repair or replacement, up to $500 per incident

6.3 Limitation of Liability

Clean Peachy's total liability for any claim arising from or related to the Services shall not exceed the amount paid for the service during which the claim arose. We are not liable for:

• Pre-existing damage or wear
• Damage to items left in cleaning areas
• Loss of items not secured by Customer
• Damage caused by Customer's property conditions
• Consequential, indirect, or incidental damages

7. Termination

7.1 Cancellation by Customer

You may cancel your service agreement at any time by providing written notice (email is acceptable). Cancellation takes effect after your final scheduled service. No refunds will be provided for services already rendered.

7.2 Termination by Clean Peachy

We reserve the right to terminate this Agreement immediately if:

• Payment is more than 30 days overdue
• You violate any term of this Agreement
• Our team feels unsafe at your Property
• You engage in abusive or inappropriate behavior toward our staff

8. SMS and Electronic Communications

8.1 Consent to Communications

By providing your phone number and email address, you consent to receive:

• Service reminders and confirmations
• Billing notifications
• Updates about your service
• Occasional promotional messages

8.2 SMS Terms

By agreeing to receive SMS messages, you understand that:

• Message and data rates may apply
• Message frequency varies based on your service schedule
• You can opt out at any time by replying STOP
• For help, reply HELP or contact us directly
• Carriers are not liable for delayed or undelivered messages

8.3 Electronic Signatures

You agree that clicking "I agree" constitutes your electronic signature and has the same legal effect as a handwritten signature. This Agreement complies with the federal E-SIGN Act and applicable state electronic signature laws.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into this Agreement by reference.

We collect and use your information to:

• Provide and improve our Services
• Process payments
• Communicate with you
• Comply with legal obligations

10. Dispute Resolution

10.1 Informal Resolution

If a dispute arises, we encourage you to contact us first to seek an informal resolution. Many disputes can be resolved quickly and to your satisfaction through direct communication.

10.2 Binding Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Arbitration shall take place in the county where your Property is located.

10.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11. General Provisions

11.1 Entire Agreement

This Agreement, together with your Service Contract and our Privacy Policy, constitutes the entire agreement between you and Clean Peachy regarding our Services and supersedes all prior agreements and understandings.

11.2 Amendments

We may modify this Agreement from time to time. We will notify you of material changes via email or SMS. Your continued use of our Services after such notice constitutes acceptance of the modified Agreement.

11.3 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state where your Property is located, without regard to its conflict of law provisions.

11.4 Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

11.5 Assignment

You may not assign this Agreement without our prior written consent. We may assign this Agreement to any affiliate or successor in the event of a merger or sale of our business.
